Personal injury lawyer is a lawyer who represents a case or personal injury. Personal injury lawyer provides legal help to the person who have been injured due to the negligence or mistake of another person. The injury can be anything such as physically or psychologically. Here injury can happen due to many things such as a person, a company, a government agency, or any other entity. This personal injury lawyer has more knowledge and also more experience in a special are of law known as tort law. Here tort law means laws which include civil wrongs and economic or non-economic damages to a property, reputation or rights of any person. But a personal injury lawyer is not forced to practice law including tort law only. They can practice any field of law.
There are several responsibilities which a personal injury lawyer has to serve to his clients. These responsibilities can be anything such as ethical rules and code of conduct which are set forth by state bar associations from where the lawyers are licensed. Lawyers can file legal complaints only after getting legal permits by their state bar association. After filing legal complaints lawyers have to argue cases in state court, draft legal documents, etc.
Most of the time, a personal injury lawyer is also responsible for interviewing their prospective clients. They also have to evaluate their cases for determining the legal matter and extensive research are done for building a strong case. The main goal of a personal injury lawyer is help their clients in getting justice and compensation which they deserve. The clients can have losses due to many reasons such as suffering through advocacy, oral arguments, client counseling and legal advice.
Every country has its own rule and certification for practicing law in that country. In United States a personal injury lawyer can practice if he had passed a written bar examination and in some cases, a written ethics examination. These bar examinations vary state to state wise. But in most states a person have to complete a four year college degree and then a law degree from an accredited law school. There are some exceptions cases such as California. But it is necessary for every lawyer to take the Multistate Bar Examination (MBE), the Multistate Essay Examination (MEE), and the Multistate Professional Responsibility Examination (MPRE). In some state there is a requirement for another test also which is called Multistate Performance Test (MPT).
After admitting to the state bar, the lawyers have to remain up-to-date on the latest legal developments. They have to complete continuing legal education (CLE) courses also. To get certified as a specialist, lawyers have to complete specialty certification program accredited by the American Bar Association (ABA).
There are some common professional associations in which a personal injury lawyer of United States may join. These are:
1. American Bar Association – It is an association dedicated for improving the legal system.
2. Association of Personal Injury Lawyers – This association was founded in 1990.
3. Association of Trial Lawyers of America – This is an association of trial lawyers founded in 1946 by a group of Plaintiff’s attorneys.
